Chairman Best called the March 19, 2003 meeting of the Triple S Planning and Zoning Commission order at 6:30 p.m.


Mulberry Heights Section I Final Kerry Magan

Kerry Magan representing Carricato Associates, the owners of Mulberry Heights: This property is off Trace Lane and it is 15.66 acres. We were here in September 2002 with the preliminary plan of this property. We are here now requesting final approval for Section I. There will be 37 single-family lots and one non-buildable parcel labeled A in this section. The minimum lot size is 7,500 sq. ft. and the typical lot size in this development is 8,100 sq. ft. We are not requesting any waivers. Parcel “A” is essentially the floodplain and that is labeled on the plat. We comply with the regulations and I will answer any questions.
Best: Did Fiscal Court get satisfied on the development of this property as far as the drainage issue is concerned?
Magan: Yes, they concluded the zone change process in settlement of the Circuit Court suit with condition that we design and construct a storm water detention basin. The basin shown in Section I has been sized for the entire development.
Best: Anyone on the Board have any questions?
Bemiss: For the record the bond for $554,231.00 has been filed in the office.
Tucker: You did say the detention basin will serve the entire project.
Magan: Yes, that is right it has been sized for the entire 87 lots.

Rudolph: Who will be responsible for the retention basin?
Magan: The Homeowners Association will be, unless County regulations are changed.

Rockbridge Heights Tracts 17B & 18 Amended Plat Kerry Magan

Kerry Magan, representing the Shirley’s, the owners: Rockbridge Heights was created in the 1970’s and there have been amended plats recorded. A lot of the plats have affected the sale of property between adjacent lot owners. The property is zoned R-2 several months ago and the zone change included all the property owned by the Shirley’s. With the zone change a five-acre tract with the house was shown. Since the zone change was approved the storm water analysis has been enacted by Planning & Zoning. Anyone looking at the plat has requested the existing pond stay with the property. They have lost sales of this property because 5 acres was too much. This tract is for 2.14 acres for sale. I would like to ask that this be approved.
Best: The five acre tract as it exists is zoned Residential?
Magan: Yes, it is R-2 as well as the balance of the property the Shirley’s own.

Tucker: The existing pond, will that take care of future development on Tracts 17 & 18?

Breighton Business Center Section 2 Lot 22 Development Plan Kerry Magan

Best: The owners requested this be held over, so this will not be heard.




A.V.B. Farm Divided Minor & Agricultural Division Charlie Moody

Charlie Moody, representing the owners: This is a minor division and an agricultural division located on Vigo and Elmburg Roads. This property is zoned agricultural. The farm is approximately 293 acres being divided into 21 tracts, two, 2-acre tracts and 19 tracts of five acres and larger.

On the staff report the Murphy tract needs the deed book and page number noted on the plat, which has been done. This tract was sold in 1958.

Moody cont’d: There was a concern on the staff report concerning the cemetery. I have revised the plat and noted a 30’ easement for access to the cemetery. There was a concern about the buildable area for tract 1. There is an electrical line but there is still plenty of room for a house. We have all the required signatures. The restrictions are on file. On the Agricultural Division tract 19A is noted as non-buildable. The adjoining property owner wants to buy that. We believe this meets the regulations and we ask for approval and I’ll answer any questions.

Randy Freezen, adjoining property owner: We bought an acre of land about 14 years ago and we moved there because of the agricultural area. We have a concern that this takes away from the agricultural area. You really can’t farm 5 acres. There are children along Vigo Road and we have a concern of the extra traffic, what is the safety of people coming out of the driveways? Would this road be widened to make it safer? This would be extra traffic on that road.
Best: It is not likely the road will be widened. The State checks the site distance and gives approval for a driveway.
Freesan: My main concern is the extra added traffic.
Moody: The State highway department did check the entrances. Tracts 5 & 6 will have a joint entrance.

Brassfield Section 3 Preliminary Charlie Moody

Charlie Moody representing the owners: This is in Brassfield Subdivision, zoned R-2 5.79 acres on Shelley’s Place. This is the last to be developed in Brassfield. We are proposing 12 lots. The staff report had a question about detention. There will be a detention area in the rear of lots 42 thru 46 and part of that will also be in the rear of North Country Section IV Phase I. We will be coming in soon with the final plat for North Country Section IV Phase the detention area and I will be further defined on that plat. To be noted on the plat that no parking will be allowed on the street and double driveways will be provided.
Bemiss: The buildable area on lot 41 looks awfully scrunchy.
Moody: It is, but there is in excess of 30 feet in depth and there is ample length. There is room for a house on that lot. We have all the required signatures and we ask for approval.

Todd Station Phase II Final John Carroll

John Carroll, representing the owner: Let me deal first with the issue of our roadway commitment. The preliminary plat was approved for phase II in August of 2002 without a requirement for a left turn lane based on our commitment to pay $50,000. for roadway improvement. We have put that commitment into a written agreement, it has been signed by the president of Shelby Properties and by the Mayor of Simpsonville. It has been reviewed and the agreement calls for that $50,000. payment to be made within three (3) business days after the final plat is approved for phase II. Assuming that is done tonight, the $50,000. will be paid to the City of Simpsonville on Monday.

Agreement submitted for the record.

We have reached an agreement with Mr. Holloway, the adjoining property owner to the west with respect to drainage improvements on his property. Several dissipaters have been installed to alleviate that problem. We have made commitments to Mr. Holloway and plan to stick by those commitments. On final issue is that a 10% contingency on the sewer bond has to be posted. That will be posted the first of next week.
Bemiss: For the record, most of the bond for the infrastructure has been posted in the amount of $633,405.
Carroll: The staff report asked for landscaping on the lots next to the railroad.
Kevin Young: There are eight (8) lots next to the railroad tracks. We are proposing a staggered row of evergreen 25 foot on center for the length of the property line. That is 38 pine trees.
Carroll: We ask your approval and we will answer any questions.

Ernie Threlkeld: Regarding the $50,000. If all of that amount is not used for the road and improvements, could some be used to mow the property that faces Todds Point Road? I have talked to the City Manager and he isn’t sure if they can do that. We would appreciate any help in getting the grass mowed.

Lotz Property Pre-Preliminary Lawrence Lotz

Lawrence Lotz: I have a sale for five acres and my house. To divide my 10.7 acres I am coming up short on the road frontage. I only have 189 feet of road frontage with the tract I am selling and I am asking for a waiver. There is 250’ of frontage on the 5 acres I’m keeping.

Rudolph: Is the 10.7 acres all you have?
Lotz: Yes, that is all.
Best: I cannot sign the plat as it is. You all need to give approval for me to sign off on it at the office and not come before the Board. A motion is in order.
Mr. Rudolph made the motion to approve the waiver for 189 feet of road frontage and for the Chairman to sign off on the plat.

Best: We have a request from Fantastic Sams that was previously approved. They are requesting to move the sidewalk and build 2 feet to the north. They will submit an amended plat. It really doesn’t affect anything. Is there a motion?
